Proposal:Request for the Return of 3,681.59 ETH from Wau Holland Foundation to the AssangeDAO Treasury

AssangeDAO is a decentralized autonomous organization formed by global cryptocurrency supporters to assist Julian Assange’s fight for justice through blockchain-based coordination and funding.

Now that Julian Assange has been released and the core mission of the DAO has been fulfilled, the community is seeking closure and accountability.

Nearly one year has passed since Assange regained his freedom, yet no formal communication has been made by the DAO regarding this historic moment — this is an abnormal silence for a movement of such magnitude.

According to our shared values and decentralized mandate, this proposal formally requests that the Wau Holland Foundation (WHF) return the remaining 3,681.59 ETH to the AssangeDAO treasury.


:books: Rationale

1. Mission Accomplished
The central purpose of AssangeDAO — to support Julian Assange’s legal struggle and restore his freedom — has now been achieved. The remaining funds should be returned to the community and reallocated toward future decentralized initiatives, public goods, or new missions as determined by DAO-wide votes.

2. Community Ownership
The original donation funds were raised by thousands of global supporters. These ETH donations were never intended to become the permanent custody of a foundation. Rather, they were held in trust by WHF on behalf of the DAO. Now that the original purpose has been fulfilled, the funds should be returned to their rightful owners: the AssangeDAO community.

3. Fiduciary Responsibility
Under German law or ethical stewardship frameworks, if funds cannot be returned directly to the DAO due to legal status, the Wau Holland Foundation should transparently propose an alternative, legally compliant solution — such as refunding to a registered DAO entity or structured intermediary.

It is illegal to keep the remaining funds in the German foundation permanently. The best solution is to return them to Assange Dao, and this should be done. Assange Dao is the legal entity. We should jointly control the remaining funds and continue to do just work. This is the path of justice. This fund does not belong to any individual. It is Assange Dao’s asset.

Zylo has already discussed and thinks the DAO will have to set up a legal entity that will be accepted by the German Tax office for the funds to be submitted.

If this proposal went to a vote and was passed then what - not sure how it compels WH to respond. Although such activity could be made public and WH may then act to oblige? The AssangeDAO has a very strong case IMO to have unused funds returned.

Also as Harry Halpin once commented - the AssangeDAO would need to seek a grant for a specific project to satisfy a German tax audit. So the DAO would probably have to do some legwork on which project would work. We need more insight into how that works.

Given Assange’s good personal relationship with WHS, we still hope that he will make some contacts and mediation. Perhaps all of our efforts are not as good as his, but we know nothing about it.

WHS has repeatedly reiterated that Pak is a donor and DAO is a consumer, but at the same time admitted that it is reasonable to return the remaining funds to DAO, but there are some difficulties in law.From a legal point of view: No. From an ethical point of view: Yes.

I asked him whether he could return the funds if DAO was registered as an entity, but I have not received his reply yet.
